Judge dismisses challenge to Clean Elections system

PHOENIX A lawsuit challenging the constitutionality of Arizona's "Clean Elections" public campaign funding system was dismissed today.

The system provides public campaign dollars to participating candidates for statewide and legislative offices.

Participating candidates get extra money when the war chests of privately financed opponents exceed certain thresholds.

The challenge by the Association of American Physicians and Surgeons and three Republicans who ran for office in 2002 alleged the matching funds are an attempt to coerce candidates into accepting public funding for their campaigns.

They said the Clean Elections system violates the free speech rights of privately funded candidates because it provides matching funds to participating candidates.

U-S District Judge Earl H. Carroll ruled today that the provisions challenged by the lawsuit were constitutional.

A lawyer for those who challenged the law says his clients will probably appeal the ruling.
